CakeVersity® (“the Company”, “us”, “we”, or “our”), operates the website www.cakeversity.com. We may change or add to this terms of business, so we encourage you to come back and read it periodically. CakeVersity® is the data controller that resides in 2 Summers Park Avenue, Lawford, Manningtree, Essex CO11 2BX
These terms of business governs the website CakeVersity® and informs you of our policies regarding the terms under which you enter into when you purchase any of our courses or memberships.
- Classes
1.1 All course, class and membership materials remain the property and copyright of Sarah Thomas / CakeVersity®.
1.2 You agree not to teach or share with any other person, in person, via social media, the internet or by any other means, inter alia information, techniques, designs or recipes learnt. All designs, class notes and other documents, teaching methods, recipes remains our property.
1.3 If we believe at any time that you intend to reteach or share in any way any content of our courses, classes or memberships or we believe you may be disruptive by way of behaviour or otherwise to the detriment of other students/members, we reserve the right to immediately cancel your access. No refunds will be offered in these circumstances whatsoever.
1.4 We reserve the right to cancel your place on any class if we feel you are in breach of these terms and conditions.
1.5 Payments are due in full immediately. If we have agreed to receive a recurring payment, all payments remain due regardless of whether you retain access to the courses/memberships. All payments must be completed in order to retain access to courses and memberships. Missed payments will result in immediate cancellation of access and exclusion from courses/memberships. If a recurring payment is missed, the balance will become due in full immediately. We will take action to recover any missed payments due whatsoever. You will be liable for any costs incurred.
1.6 We will not issue reminders for payments not received either in part or full.
1.7 Deposits, part payments or payments in full are non-refundable.
1.8 For purchases made online you are entitled to a full refund for any services not yet received under UK law within 14 days of the date of booking. After this time no refunds will be allowed whatsoever.
1.9 Under these terms, if you attend any course or membership within the 14 days “cooling off” period, and services are delivered in full in that time, you waive your right to request a cancellation and receive a refund. If you book a class which falls within 14 days of your booking, but you fail to attend for any reason whatsoever, you also waive the right to cancel and receive a refund.
1.10 If a payment is made for a digital download or a class that is available immediately, you have no right to request a refund, and waive any such rights as there may be.
1.11 It is your responsibility to download any apps required onto your device and to understand how to access and use.
1.12 Under no circumstances are you to share login, access, or meeting invitations with another party. If this occurs all involved parties will be removed from the meeting.
1.13 Recording and/or sharing of online classes is strictly prohibited.
- General
2.1 All content of the CakeVersity® website, courses and memberships including, but not limited to, designs, layout, wording, text, photographs, belong to us and may not be copied, duplicated or used in any format or for any purpose without the express permission of us.
2.2 CakeVersity® or its owner will not be liable for a failure to perform or a delay due to events outside of its control including, but not limited to:
- failure to deliver material or class/membership material due to a 3rd party failure beyond our control
- extreme weather conditions preventing delivery of class materials or information, including but not limited to, storm, snow/ice, fire, floods, or any natural disaster whatsoever
- Breakdown or usability of any relevant tech or platforms beyond our control, whether our own, a 3rd party’s or your own
- any act, or attempted act of terrorism
- any epidemic or pandemic, or other localised disease or illness, whether previously known or otherwise
2.3 We will endeavour to minimise any disruption to delivery of materials due to an event beyond our control. No refunds will be offered.
2.4 All personal details supplied to us are confidential and will not be disclosed to any 3rd party. All such details will be destroyed when they are no longer required for our records and will only be held for the time they are required. Please refer to our privacy policy.
2.5 The maximum liability of CakeVersity® will not be more than the price of the product or cost of the service.
2.6 English law will apply to all aspects of any arrangements for the provision of services or products, including the terms above, interpretation and all other disputes or matters arising.
2.7 These Terms are subject to change at any time without prior notice.
2.8 We (CakeVersity® / Sarah Thomas) are not responsible for the success or failure of your results relating to any or all information or content provided by our company nor do we make any guarantee of your results. In making any payment, whether as a deposit, a subscription or payment in full, you agree to completely release us from ANY and ALL liability for any types of losses or damages (Monetary or otherwise) that you or any third party may incur from your use of our services, websites or livestreams regardless of platform.
